GALVESTON - Galveston City Council Member Jason Hardcastle was arrested Friday evening following a two-vehicle crash on Seawall Boulevard, facing charges of driving while intoxicated and resisting arrest, according to a Galveston Police Department press release issued Saturday, October 31.
Officers responded to the crash at approximately 8:15 p.m. on Friday, October 30, in the 6800 block of Seawall Boulevard, police said, and no injuries were reported. According to police, an officer observed signs of possible intoxication involving Hardcastle, and following an investigation officers arrested him on suspicion of driving while intoxicated, first offense, a Class B misdemeanor. Police said Hardcastle declined to provide a breath sample.
While officers were executing a warrant at the hospital, Hardcastle allegedly physically resisted their efforts, resulting in an additional charge of resisting arrest, search or transportation, a Class A misdemeanor, police said. He was booked into the Galveston County Jail with bond set at $1,000 on the DWI charge and $1,500 on the resisting charge. Galveston police confirmed Saturday that he was no longer in the county jail.
Attorney Jonathan Zendeh Del said his firm, Zendeh Del & Associates, PLLC, will represent Hardcastle and has begun reviewing the evidence and circumstances surrounding the arrest; in a statement provided to KGTX 7, he said the defense intends to challenge the allegations, including the scientific evidence and constitutional issues involved in the case. The charges are allegations that have not been adjudicated in court, and Hardcastle is presumed innocent unless proven guilty.
